New IN RE PETITION
FOR ISSUANCE OF NEW COMES NOW the petitioner by the undersigned attorney, and unto this Honorable Court, respectfully alleges: 1. That on ______________________, petitioner presented to the Register of Deeds of _____________________for registration a deed of sale of a certain parcel of land located in __________________wherein ___________________ was the vendor, and your petitioner, the vendee; 2. That said deed of sale on said date was duly entered in the Entry Book of the said Registry of Deeds as Entry No.___________________, VOL _________________; 3. That said deed of sale as thus presented was accompanied by the owner's duplicate certificate of title, Transfer Certificate No. ___________ of the Register of Deeds of ________________; 4. That pending registration of the above papers and documents, and while same were in the possession and custody of the Office of the said Register of Deeds, the building in which was housed the Office of the Register of Deeds was burned to the ground, together with all its records and papers; 5. That upon the re-establishment of the said Office of the Register of Deeds, petitioner made inquiries of said office regarding the above deed of sale and accompanying Transfer Certificate of Title No.______________ but was informed that said papers were missing and were not among those salvaged from the fire wreckage; 6. That in view of the above, the said Transfer Certificate of Title No. _______________the Register of Deeds of __________________must be deemed to have been lost or destroyed. WHEREFORE, pursuant to law, and in view of the fact that said Transfer Certificate of Title had been lost or destroyed, it is respectfully prayed, that, after due proceedings, an order be entered directing the Register of Deeds of _____________ to issue a new duplicate certificate of Title No. ___________________, the same to be regarded as the original certificate for all purposes of the law. __________
